As part of their expansion, they are seeking a highly skilled Senior Collections Attorney to join their dynamic legal team.
Position Overview:
As a Senior Collections Attorney, you will play a pivotal role in safeguarding the financial interests of the company by handling litigation efforts and providing strategic legal counsel regarding bankruptcies and complex workouts. You will lead the company's legal efforts to recover funds from defaulted accounts and ensure compliance with relevant laws and regulations. This position requires a proactive, results-driven attorney who thrives in a fast-paced environment and is passionate about working in the fintech space.
Key Responsibilities:
Represent the company in collections-related litigation to recover outstanding funds from defaulted accounts.
Prepare, file, and argue motions, complaints, and other pleadings in state and federal courts.
Provide legal counsel and strategy for dealing with bankruptcies, including evaluating and advising on debtor estates, filings, and creditor priorities.
Advise on complex workouts, restructurings, and settlement negotiations for non-performing accounts to achieve optimal recovery outcomes.
Ensure all litigation, bankruptcy, and collections activities are in compliance with state and federal laws, including the Fair Debt Collection Practices Act (FDCPA).
Work closely with internal teams, including business development, risk management, and finance, to strategize and implement legal actions aimed at minimizing loss and maximizing recoveries.
Provide ongoing legal guidance to senior management on debt recovery strategies, financial risk management, and potential legal implications for the business.
Mentor junior attorneys and legal staff on best practices in collections law, bankruptcy, and workouts.
Qualifications:
At least 3 years of relevant experience in collections litigation, bankruptcy law, and complex financial workouts, gained at a reputable law firm or in a sophisticated in-house legal environment.
Active Florida Bar membership required.
Proven experience in managing complex collections cases and bankruptcy proceedings.
Strong analytical and problem-solving abilities.
Excellent written and verbal communication skills.
Ability to handle high-volume caseloads and prioritize effectively in a fast-paced, results-driven environment.
Expertise in financial transactions, debt recovery, and risk mitigation strategies.
Self-motivated, with the ability to work independently and as part of a team.
A proactive and adaptable approach to legal challenges in the fintech space.
Strong negotiation skills with an ability to achieve favorable outcomes for the company.
